A U.S. federal appeals court has overturned the conviction of Douglass Mackey, a far-right activist, who was accused of using misleading memes to deceive voters during the 2016 U.S. presidential election. Mackey had been convicted in 2023 for conspiracy against rights after posting memes on Twitter that falsely claimed supporters of Hillary Clinton could vote by texting “Hillary” to a specified number. The court’s ruling on Wednesday clears Mackey of these charges, citing insufficient evidence to prove that he intentionally participated in a conspiracy to suppress voters.

Douglass Mackey, who operated under the alias “Ricky Vaughn” during the election, became notorious for spreading misleading content that targeted Clinton supporters. He posted memes resembling Clinton campaign ads, with messages claiming voters could vote from home via text message. The memes, which featured misleading logos and fine print, were designed to mislead voters and reduce turnout for Clinton.

One meme showed a Black woman with a sign reading “African Americans for Clinton,” along with the text “Avoid the line. Vote from home,” and was followed by the hashtag #ImWithHer. Another similar meme in Spanish aimed to further mislead potential Clinton voters.

Court’s Skepticism of the Conspiracy Charges
The 2nd U.S. Circuit Court of Appeals expressed doubts about the prosecution’s claims of a coordinated effort to deceive voters. Chief Judge Debra Ann Livingston wrote that while Mackey posted the memes, there was no clear evidence that he was aware of, or participated in, a conspiracy to suppress votes. The court found that Mackey’s posts alone were not enough to prove criminal conspiracy, as there was no evidence that his actions tricked voters into voting incorrectly.

Lack of Evidence of Voter Deception
The court noted that approximately 98% of the individuals who texted the number listed in Mackey’s fake ads received an automated response informing them that the ads were not affiliated with Clinton’s campaign. The appeals court ruled that this undermined the argument that Mackey’s memes had a direct impact on voter behavior. No proof was provided that the posts led to voters failing to vote correctly.

Mackey’s conviction reversal signals a potential shift in how courts view misinformation campaigns, particularly in the context of election interference.
